The Consumer Services Division of the Delaware Insurance Commissioner’s Office protects, advocates for, and informs consumers of their rights and options when it comes to insurance. Policyholders are encouraged to contact the Consumer Services Division with general questions they may have about insurance or if they have problems or complaints. A policyholder can request assistance from, or file a complaint with, the Consumer Services Division if they are having a problem involving an insurance company or agent. The Consumer Services Division can be reached at 1-800-282-8611 in Delaware and can also be emailed at consumer@delaware.gov.
To file a Consumer Complaint with the Consumer Services Division, use the form located here. After the electronic final submission of the Consumer Complaint form, you will be provided with an opportunity to attach supporting documents. Once filed, the Consumer Services Division investigates the complaint and can: forward a copy of your complaint to the insurance company, if appropriate; obtain information or explanations on your behalf from the insurance company or their representative; review in detail the information obtained from your insurance company for compliance with statutes, regulations and their own policy contracts; and if it is determined that the actions of the insurance company are in violation of a statute, regulation or policy it enforces, it may take corrective action.
The Consumer Services Division, however, cannot act as your lawyer or give you legal advice. Therefore, if you are not satisfied with the Consumer Service Division’s response to your complaint, are not certain of your insurance claim rights, or if you have questions about your insurance policy’s benefits, please do not hesitate to contact Merlin Law Group.
